Common DUI Questions

What are the penalties for a DUI?

The penalties for first DUI offense may include are two days in jail or 96 hours of community service, between a $200 and $1000 fine, $70 in court costs, a $60 chemical test fee, and a drunk driving education course, including mandatory attendance at a victim impact panel. If your blood alcohol level was 0.18 or more or you are under the age of 21, you must also pay $100 to have an alcohol evaluation done.

What is Blood Alcohol (BAC) limit in Nevada?

In Nevada the blood alcohol limit is .08%. The limit is .04% for commercial drivers and .02% for drivers under 21. Drivers can be arrested and convicted for DUI with a lower blood alcohol content (BAC) reading or for driving under the influence if impairment is due to controlled or prohibited substances.

What if the officer never read me my "Miranda" rights?

The Fifth Amendment requires the arresting officer to advise you or your rights by reading you the “Miranda Warning.” If the officer fails to give you a Miranda Warning the prosecution may not be able to use answers or testimony asked after the arrest.

What should I do if I'm asked to take field sobriety tests?

Nevada law enforcement will typically perform three standard Field Sobriety Tests (FST); heel-to-toe, eye test called "horizontal gaze nystagmus", and standing on leg. Unlike the breathalyzer test that has legal consequences for your refusal you may refuse the FST. The tests are simply used to confirm a police officer’s suspicion of your impairment and if you refuse the officer may still arrest you and ask you to perform a breathalyzer test.

What is a Horizontal Gaze Nystagmus (Nystagmus) test?

During this test, the officer asks you to follow a pencil or penlight with your eyes to estimate the angle at which the eye begins to jerk ( or to cause nystagmus). Nystagmus is a medical term for a distinctive eye oscillation. If this occurs sooner than 45 degrees, it theoretically indicates a blood-alcohol concentration over .05%. The smoothness of the eye's tracking the finger or pencil is also a factor to impairment.

What if I refused the breathalyzer test?

Under Nevada’s "implied consent laws" refusal carries penalties that can include compulsory suspension of a driving license for up to a year.
