Divorce & Child Custody Information

Common Nevada Divorce Questions

How Does The Divorce Process Start?
The process of divorce starts with one spouse filing with the court and serving the other spouse with a “Complaint". The “Complaint” is the legal paperwork that asks the court to grant a divorce and opens the case. More Divorce Process information.

I Was Just Served With Divorce Papers. What Do I Do Next?
You need to contact an attorney immediately. After being served with divorce paperwork you only have 20 days and sometimes only 10 days to respond to the "Complaint" with an "Answer". An "Answer" is your legal response to your spouses issues and claims described in the "Complaint".

How Is Child Custody Determined?
Two aspects of child custody must be determined; Legal Custody and Physical Custody. Legal custody focuses on decisions regarding education and healthcare. Physical custody is where the child(ren) resides. Both legal custody and physical custody can be determined as "sole", "primary" or "joint". More informaiton can be found on the Child Custody page.

How is Child Support Calculated?
Nevada statutes establish specific calculations and percentages to determine child support. Visit the Child Support page for percentages and more information.

How Are Debts And Property Divided?
Debts and property can labeled as "community" or "separate". Community property or debt are established while married and generally will be split 50/50. Separate property or debt is established before marriage and each party will take with them property or debts ruled as separate. More Property & Debt Division Information.

Do I Need to Hire A Divorce Attorney?
It is recommended to consult an attorney if there are children involved, if you jointly own property, if you need to separate debts or if you and your spouse cannot agree on major issues.

What Happens During Divorce Consultation?
A consultation is your opportunity to speak with an attorney and to receive legal recommendations regarding your specific situation. If you are outside of Las Vegas, Nevada our office can schedule a consultation by telephone. Rocheleau Law charges a nominal fee of $125 for a consulation and if our firm is retained the consultation is free.

How Much Will A Divorce Cost?
This question is difficult to answer without understanding the complexity and details of your specific situation. After your consultation an attorney will be able to give you a better idea of the costs involved.
